Wes Benedict: The Problem With Toll Roads

Dear Friend of Liberty,

Last week I issued a statement that included a criticism of Texas Governor Rick Perry's support for toll roads. Several people asked for an explanation about my stance on toll roads and I can understand why.

The Libertarian Party platform says "We seek to divest government of all functions that can be provided by non-governmental organizations or private individuals." Private toll roads could fit that bill. Some free-market think tanks have promoted toll roads as a positive option.

Don't privately-run toll roads sound more libertarian than government roads?

So what's up? Why am I opposed to toll roads?

If we were talking about an open system where private companies compete with each other to build roads, buying their own right-of-way, taking the risks and earning the profits, I'd be a supporter.

But that's absolutely not what we're talking about. In almost every case, "toll roads" are a mechanism where government remains in charge, but manages to take more of your money. It's a slick sales job to fool people.

In Texas, the plan was for a single private monopoly company to get the concession to build and maintain roads. No competition allowed. Even the government couldn't compete. That meant that the government would intentionally allow the traditional non-toll roads to decay, and they would lower the non-toll speed limits, in order to fulfill their agreement. But don't think for a minute they would lower the gas taxes and other taxes used for those roads. You'd be paying just as much tax, and the government would intentionally be delivering less.

You might end up having to drive on the toll road, where the owning company (thanks to its government-guaranteed monopoly) could charge you however much it wanted.

I'm all for corporate profits -- but not when it's a government-guaranteed monopoly.

It was also very questionable how much the private company was "taking the risks." If things didn't work out, it was very likely that the government would bail out the private company with tax dollars, and then take over the road. (While continuing to levy both taxes and tolls.)

I don't want our state and federal governments to have more revenue and more debt. I want them to have less of both. I also don't want them picking out their cronies' companies to be the big beneficiaries of monopoly concessions. I hate it when politicians dictate winners and losers.

I don't want the government to increase the financial burden on citizens, in order to create an illusion of privatization. Tolled highways can cost twice as much to build per added lane-mile as non-tolled roads, and ten times more than ground-level thoroughfares.

In the northeast, many people have listened to politicians talk about how tolls were only going to be charged until the road was paid for, and then the tolls would be removed. Yet somehow, the road never quite got paid for, or they changed the rules, and the tolls remained indefinitely.

One more thing: In Texas, Rick Perry planned to use eminent domain to seize huge amounts of private land for the toll road network. I strongly disagree with eminent domain seizures.

Unfortunately, the government almost completely controls the building and maintenance of roads in America. And it's really hard, if not impossible, to privatize it "a little bit." That just ends up making it more complicated, corrupt, and expensive.

Maybe someday, someone will come up with a toll road plan that really makes sense from a Libertarian point of view. Rick Perry absolutely failed to do that in Texas.

Ron Paul gets the shaft

I admit I do not fully understand Ron Paul and his beliefs. But I do understand when a guy gets shafted, and Ron Paul just got shafted.

On Saturday, the Ames Straw Poll was conducted in Iowa amid huge media interest and scrutiny. The results were enough to force one Republican candidate, Tim Pawlenty, out of the race, and catapult another, Michele Bachmann, into the “top tier.”

There are so many “top tier” stories in the media today that I can barely count them, let alone read them all, and Bachmann is in all of them by virtue of her victory at Ames. The rest of the tier is made up of two candidates who skipped Ames, Rick Perry and Mitt Romney.

As The Daily Beast put it: “The new top tier of Bachmann, Perry, and Romney — created by Bachmann’s Iowa straw poll win, Perry’s entry into the race and Romney’s lead so far in many national and state polls — has unleashed torrents of talk about the reshaped race.”

Paul’s name was not mentioned in this piece nor in many others. A Wall Street Journal editorial Monday magnanimously granted Paul’s showing in the straw poll a parenthetical dismissal: “(Libertarian Ron Paul, who has no chance to win the nomination, finished a close second.)”

AMES, IOWA – August 13, 2011 – News reports, as well as Ron Paul himself, indicated that the twelve-term Texas congressman was expected to do well in today’s straw poll in Ames. Today’s second-place finish – by a razor-thin margin against local favorite Rep. Michele Bachmann – is a clear victory for Congressman Paul, who neither hails from Iowa nor espouses the foreign interventionism that continues to resonate with some Iowa Republicans.
“Any candidate has reason to celebrate a strong showing like Congressman Paul’s in Iowa,” said Thomas Woods, Revolution PAC advisory board chairman, “but given how radically different Ron Paul’s message is, he should be especially delighted to have come within a handful of votes of first place – a poll in which he placed fifth four years ago.
“Ron Paul is taking dead aim at issues no one else will even touch,” noted Woods. “No one was talking about the Federal Reserve System until someone of Ron Paul’s boldness and knowledge came along and showed us how this institution was making our economy so unstable and ripping us off in the process. No one questions the premises behind our government’s disastrous foreign policy. Ron Paul is trying to undo 100 years of brainwashing, from both official Left and official Right. The Left has its faith in Big Government at home, and the neoconservative Right an equally misplaced faith in Big Government abroad. Both have embraced fairy tales over real history.
“Ron Paul rejects it all. The same corrupt political class that has wrecked our economy is the same corrupt political class that has us mired in these trillion-dollar wars. It’s about time both sides woke up and realized they’ve been had. That’s what Ron Paul is trying to tell his countrymen. And in light of his strong showing in Ames, the message is getting through.”
According to Woods, the Congressman’s willingness to take politically unpopular positions on the very eve of the straw poll was an indication of the strength of the candidate’s convictions. “Congressman Paul said things in that debate – reminding the crowd that people tend not to like it when the CIA installs dictators and secret police in their countries, as happened in Iran in 1953 – that were not calculated to curry favor with the crowd he was wooing at Ames. But that’s who he is. He would rather tell unpopular truths than win cheap votes or applause. He’s not a blowdried phony out of central casting, like most of the candidates our system serves up to us. He is a real person with real principles, and he has stuck to them since entering public life 35 years ago. Even his bitterest opponent has to respect that.”
To be sure, in the days leading up to the straw poll, media sources were already trying to downplay the event’s significance. “This is typical of the media,” said Revolution PAC President Gary Franchi. “If it looks like one of the officially anointed candidates isn’t going to win, they grab their toys and whine all the way home. But even the media is going to have a hard time pretending it doesn’t really matter that Congressman Paul did so well in a state where his limited-government philosophy is a hard sell even to many self-described conservatives.”
What’s more, strong showings in Ames have often translated into strong showings at the important Iowa caucuses at the end of the year.
“This was a great day for the Congressman,” said Franchi. “But it’s the end of the beginning. Much hard work remains ahead of us. We can now carry out that work with the confidence that the message of freedom is resonating as none of us could have imagined.”

CNN CHEATS RON PAUL

CNN seemed happy to announce that Bachman won and flashed the numbers on the screen for all the candidates (Romney got very low numbers) EXCEPT for Ron Paul! With the margin of victory being a statistical tie, anyone think the vote counters helped Michele a little bit?

Fox News Alert: Ron Paul does well in straw polls

I predict Ron Paul will have a very strong showing in today's Ames, Iowa straw poll.  One reason that my confidence is so high, is that Fox News has had an alert on it's screen for the past 15 minutes saying "ALERT: RON PAUL HAS A HISTORY OF FINISHING STRONG IN STRAW POLLS," this leads me to believe they have polled the audience and feel he is a strong contender today.

It is obviously not news that Ron Paul does well in straw polls, the only reason Fox would list this as "breaking news" would be to diminish any momentum Dr. Paul might gain from a strong showing.

It's a dirty trick but it does represent the fear that Ron Paul strikes in to the hearts of the neoconservative establishment. Look for a complete rundown later at The Oak Park Republic

Ohio high court: Health care signatures are valid

(AP)  COLUMBUS, Ohio — Opponents of the federal health care overhaul championed by President Barack Obama scored a key legal victory on Friday that should clear a proposed ballot measure for a fall vote in a pivotal state.

The chance for voters to reject parts of insurance changes will appear Nov. 8, alongside a ballot issue seeking to repeal a contentious rewrite of Ohio's law restricting collective bargaining. The first is expected to bring out Republican-leaning voters, and the other is expected to bring out Democrats in a state closely divided along political lines.

In a unanimous decision Friday, the Ohio Supreme Court rejected a liberal policy group's lawsuit challenging certification of the issue, to be called the Health Care Freedom Amendment, on the grounds petitions carrying 69,000 signatures were flawed.

ProgressOhio executive director Brian Rothenberg argued that Secretary of State Jon Husted counted signatures on petitions that contained technical errors, including the way paid circulators listed their employment.

Husted, a Republican, argued the challenge revolved around petitions carrying extra information, a practice government should not discourage.

Justices said the secretary of state is "entitled to deference."

They found that Rothenberg's charges lacked legal merit, noting "even if his challenge had substantive validity, Rothenberg's evidence is insufficient to establish that the part-petitions do not have enough signatures."

Backers of the measure lauded the decision. Ohioans for Healthcare Freedom campaign manager Jeff Longstreth said it will allow "voters to have a choice this fall if healthcare decisions should be made by patients and doctors or politicians in Washington, D.C."

Husted announced July 27 that the coalition of tea party organizations and other groups behind the measure that submitted 427,000 valid signatures, well over the roughly 385,000 needed to get the amendment on the Nov. 8 ballot.

The proposed amendment to Ohio's Constitution would keep people from being required to buy health insurance or face penalties. The federal mandate would go into effect in 2014, when new competitive insurance exchanges are scheduled to open.

Opponents say the federal government is overreaching by requiring individuals to purchase a product. The Obama administration counters that Congress' power to regulate interstate commerce squares the constitutionality of the mandate.

The Ohio court's decision came as a panel of the 11th U.S. Circuit Court of Appeals in Atlanta struck down the same requirement at issue in Ohio. Other federal courts have ruled or considered the issue, but the Atlanta-based court may be the most pivotal battleground yet because it reviewed a sweeping ruling by a Florida judge.

Rothenberg said ProgressOhio was hindered from fully reviewing all the submitted petitions because 40 percent of Ohio counties refused to respond to a public records request in the time allotted for review.

"Ohioans will now have a choice — to return to the days when children were denied insurance coverage over pre-existing conditions; return to the days when seniors have to choose between prescription drugs and groceries; return to the days when young adults can't stay on their parents insurance and return to the days when small businesses did not get tax breaks for providing insurance," he said in a statement. "This fall 'no' will be a beautiful word."

Breaking News!!! 11th circuit court of appeals rules obamacare unconstitutional

ATLANTA (AP) — A federal appeals court has struck down the requirement in President Barack Obama’s health care overhaul package that virtually all Americans must carry health insurance or face penalties.
A divided three-judge panel of the 11th Circuit Court of Appeals on Friday struck down the so-called individual mandate, siding with 26 states that had sued to block the law.
But the decision didn’t go as far as a lower court that had invalidated the entire overhaul as unconstitutional.
The states and other critics say the law violates people’s rights. The Justice Department counters that the legislative branch was exercising a “quintessential” power.
An appeals court and three federal judges have upheld the law, and two have invalidated it. Experts say the debate ultimately will be decided by the U.S. Supreme Court.

Pawlenty: We need to make sure Iran doesn't get nuclear weapons by sanctions, etc... we should also get involved in Syria, and do whatever Israel Ron Paul

Ron Paul: There is no evidence Iran is working on a nuclear weapon, look at all the Nuclear weapons surrounding Iran, of course they would want a weapon, why shouldn't we talk to them. Policy of peace is free trade, stay out of external conflicts, and bring our troops home. (LOUD APPLAUSE)

What does he think we have now? We certainly haven't had a free market in forever

My take: In the first place, it only provided relief to the big government goons who love to tax, borrow, and spend.

In the second place, we were never in danger of what they call default although the U.S. Government is in true default every day by devaluing the currency.

Thirdly,  NO FEDERAL AGENCY IS IN DIRE NEED OF MY MONEY! The business is operating better without interference from Big Brother. Close the FAA, TSA, EPA, FDA, and all other ..A's.

Before taking Michele Bachmann campaign job, Iowan reached out to Ron Paul


A reader asked the Des Moines Register if it’s true that the Iowan who became Michele Bachmann’s state campaign chairman first approached the Ron Paul campaign a number of months ago.

Did Indianola Republican Kent Sorenson originally solicit the Paul campaign for work? asked the reader, who didn’t identify herself or himself, in an e-mail late last night.

Sorenson this morning said the offer from Bachmann came first. The Minnesota congresswoman asked him to be her Iowa chairman, an unpaid position, if she were to decide to run.

He decided to say yes. But before he accepted the offer, he mentioned it to friends at the national office for Paul, a Texas congressman who has sought the White House twice before.
“I then asked if Ron was going to run, and they told me they were not sure, and they would let me know in a couple days,” Sorenson said.

The heads-up sprung from his friendship with Paul, who helped him with his successful campaign for the Iowa Senate last fall, he said.

“I never heard back from them. I didn’t ask for a job,” said Sorenson, a father of six.
Sorenson snapped up Bachmann’s offer.

“While I have a deep respect for Ron Paul’s leadership on many issues and the passion of his supporters,” he said, “Michele Bachmann more aligns with my world view.”

Ron Paul coming to Los Angeles?

The California Presidential Primary election has been merged with the statewide June Primary.  We will have an extra 3 months to identify Ron Paul supporters in California and get them registered as Republicans in order to vote for Ron in the primary.

I've heard that Ron Paul may be in Los Angeles on September 17th to attend the California Republican Party Fall Convention. He is speaking Friday at LPAC 2011 in Reno, so it makes sense for him to come down here.  I expect there will be a fundraising meeting that night.
